    It looks to me like a plugged gutter arising from poor maintenance. With large trees around such gutters must be checked or cleaned at least once a year. Is this one of those stratas where it is only a problem when it happens to the strata president’s unit?

      Yes, presently the SPA is a mere book of law that has become virtually useless due to lack of enforcement mechanisms that are accessible to strata owners. Watch the website http://www.sorabc.ca This new group will be working for legislation that better protects strata owners from strata corruption and other non-compliance with the SPA.

      The duty of the Strata Council is to maintain the common property first and foremost. By not doing so, the present council is failing to follow Section 31 of the Strata Property Act. Section 31 requires council members to act “honestly and in good faith with a view to the best interests of the strata corporation”. The section also goes on to define characteristics of a “reasonably prudent person” which is also referred to as “standard of care”. It would seem that your council is not taking care of business. The duty to represent you as fiduciary appears to be a failure as well considering the financial disclosure issues you mention. It is unfortunate your Council seems to believe it can operate outside the legislation.

      There is a new group forming with the goal of advocating for strata owners. Just as a poor council feeds off disinterest and apathy within a corporation, owners like you fuel participation in groups to foster change.
